These "Terms of Use" set forth the terms and conditions that apply to your use of WHOHUB.COM & WHOHUB.NET (the "Web Site"). By using the Web Site (other than to read this page for the first time), you agree to comply with all of the Terms of Use set forth herein. WHOHUB does not claim any ownership rights in the text, photos, video, audio, or authorship works ("Content"), that you post to your WHOHUB interview. After posting your Content to your WHOHUB interview, you continue to retain all ownership rights in such Content, and you continue to have the right to use your Content in any way you choose. By publishing ("posting") any Content on your WHOHUB interview, you hereby grant to WHOHUB a limited license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content solely on and through the WHOHUB Web Site and its RSS feeds, tweets, and blogs.
All other materials found on the Web Site are protected by United States and other copyright laws, except for works of the United States Government pursuant to 1 U.S.C. Section 105. The selection, arrangement and presentation of all materials (including information in the public domain), and the overall design of the Web Site are copyright © 2008-2009, JERNI LLC. Permission is granted to view and print materials from WHOHUB for the non-commercial purpose of viewing, reading and retaining for reference. Any other copying, distribution, retransmission or modification of information or materials on this site, whether in electronic or hard copy form, without the express prior written permission of JERNI LLC, is strictly prohibited.
WHOHUB and other trademarks and/or service marks (including logos and designs) found on the Web Site are trademarks/service marks that identify WHOHUB and the goods and/or services provided by WHOHUB. Such marks may not be used under any circumstances without the prior written authorization of JERNI LLC.
2. Content Policy
Our service is based on freedom of expression, but at the same time, WHOHUB subscribes to a series of rules of respect for the Internet community and humanity at large. The following is a partial list of the kind of Content that is illegal or prohibited to post on or through the WHOHUB Web Site:
PORNOGRAPHY AND OBSCENE CONTENT: Due to the fact that WHOHUB does not restrict access to minors, any content, in image or text, which could be considered pornographic or obscene, can be removed without prior notification.
CONTENT WHICH PROMOTES OR FOMENTS HATE: Material which promotes hate against collective groups or individual persons will not be permitted for publication.
VIOLENT CONTENT: Direct and/or violent threats against any person or group is not permitted.
COPYRIGHTED MATERIAL: Copyrighted content that does not belong to the author of the interview or person posting it, cannot be published.
CONFIDENTIAL AND PRIVATE INFORMATION: Publication of non-authorized confidential or private information of other persons is not permitted.
IDENTITY THEFT: Any form of identity theft, either explicit or confusing in any nature, is not permitted.
ILLEGAL USE OF SERVICES: WHOHUB will not permit the use of its services for any illicit or illegal services or for the promotion of any dangerous or illegal activities.
SPAM, MALICIOUS SOFTWARE, VIRUSES AND PIRACY: WHOHUB does not permit the use of its services for spamming the search engines, sending spam messages, nor for the transmission of any malware, virus, nor for the promotion or facility of piracy.
WHOHUB may delete any Content that in the sole judgment of WHOHUB violates this Agreement or which may be offensive, illegal or violate the rights, harm, or threaten the safety of any person. WHOHUB assumes no responsibility for monitoring the WHOHUB Web Site for inappropriate Content or conduct. If at any time WHOHUB chooses, in its sole discretion, to monitor the WHOHUB Web Site, WHOHUB nonetheless assumes no responsibility for the Content, no obligation to modify or remove any inappropriate Content, and no responsibility for the conduct of the User submitting any such Content.
You are solely responsible for the Content that you post on or through the WHOHUB Web Site, and any material or information that you transmit to other Members and for your interactions with other Users. WHOHUB does not endorse and has no control over the Content. Content is not necessarily reviewed by WHOHUB prior to posting and does not necessarily reflect the opinions or policies of WHOHUB.
3. Links to Third-Party Web Site
WHOHUB may provide hyperlinks to third-party web sites as a convenience to users of the Web Site. WHOHUB does not control third-party web sites and is not responsible for the contents of any linked-to, third-party web sites or any hyperlink in a linked-to web site. WHOHUB does not endorse, recommend or approve any third-party web site hyperlinked from the Web Site. WHOHUB will have no liability to any entity for the content or use of the content available through such hyperlink.
4. No Warranties
WHOHUB DOES NOT MAKE ANY EXPRESS OR IMPLIED WARRANTIES, REPRESENTATIONS OR ENDORSEMENTS WHATSOEVER (INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE) WITH REGARD TO THE WEB SITE, THE MATERIALS, ANY PRODUCTS, INFORMATION OR SERVICE PROVIDED THROUGH THE WEB SITE, OR ANY SITES LISTED THEREIN, AND THE WEB SITE WILL NOT BE LIABLE FOR ANY COST OR DAMAGE ARISING EITHER DIRECTLY OR INDIRECTLY FROM ANY SUCH TRANSACTION. This 'Terms of Use' constitutes a contract made under and shall be governed by and construed in accordance with the laws of the State of Florida.
