Interview with:

Jorge Zamarbide [zamarbide]

LAW
What did you study? What did you specialize in?
I´ am an attorney specializing in criminal law at the University of Buenos Aires, practicing in all areas of law in my own law firm.
What has been your professional experience in the arena of law? How long have you been in the profession?
I have extensive experience in trials and advocacy for people since 2003, leading civil, commercial and family only when the issue to be resolved is important.
Are there any links we can follow to see something more about you?
Of course, it´s only a matter of searching for "Jorge Zamarbide" on Google (www.zamarbide.com.ar is under construction)
What types of cases interest you most?
The most interesting cases are those who have great difficulty, requiring creative solutions.
How do clients find you? Why do you think they choose you?
I am an independent lawyer and I am loyal to the people I represent. Currently I have no advertising, clients find me through the good references from other satisfied customers.
How do you set your rates? Does it have to do with time commitment , what is at stake, or with the financial ability of the client?
Is determined by the difficulty of the case.
How do you sell a client on the strategy you develop for litigation?
I give clients choice when there are several strategies to win the case, if there´s one way out I ask them to trust my opinion.
Clients can sometimes be emotionally upset. How do you get them to adopt a realistic and rational attitude?
I hold my clients emotionally.
What do you do when your gut says your client is lying to you?
The important thing is that what the client says seems true in court
Have you ever defended someone's innocence while knowing with certainty that he/she was really guilty?
Many times.
What reasons would you have for not taking on a case? How would you justify it?
There is no reason not to accept a case, except that the damage is against me or my loved ones.
What strategy is usually effective, an aggressive and intimidating one, or one that seeks a reasonable compromise?
The strategy is different in each particular case.
Is it important to know beforehand the personality and habits of the judge that is going to decide the case?
This information is relevant to sense a possible outcome and be prepared to follow other procedural ways.
Is courage needed to practice your profession?
100 % courage.
What is justice? Is there a way to measure it, or is it only a sentiment?
Justice is what we have, not perfect but it works to maintain some order and social life in relative peace.
Should the social repercussions of a sentence, i.e., the message that it sends to society, be kept in mind?
The message of the sentence is addressed to the parties involved, whether it will affect a community must be taken into account to maintain order.
DNA analysis has revealed some serious judicial errors in the past. Isn't that a sufficient argument for abolishing the death penalty?
In my country there is no death penalty. Personally I think that in some cases appears as the only just penalty. There are always risks of judicial error, the system is not perfect.
Is it acceptable ethically to think of a lawsuit as a business opportunity?
No.
A video shows the guilt of the defendant, but because it was recorded illegally it is not admissible as evidence and the defendant goes free. Is this absurd justice?
Unable to tolerate the illegally obtained evidence. Bad procedure is sanctioned by invalidity, and also helps in the future act according to the law by helping to improve the judicial system.
What do you see as the strengths and weaknesses of the jury system?
In an advanced society jury trial is a guarantee of justice, while in the third world is a utopia.
Is it necessary to maintain a costly and slow justice system in order to avoid a flood of irrelevant cases?
Yes.
How do you see the defense of royalties in an increasingly digital future?
A promising scenario in the first world, and very hard in the third world.
Is the amount of attention paid to crime by the mass media excessive?
Yes.
What continuing education do you receive in order to keep up-to-date?
The best I can get.
Where are you headed professionally? What would you like to be doing five years from now?
I head towards excellence, experience and great knowledge, with major clients, possibly in the future can be a consultant for big companies (or the government).
What advice can you give someone with an interest in pursuing this profession?
Works independently, commitment to your client, work hard & you'll always have good money, first as a crocodile (accepting whatever) and then as an eagle (refined and exquisite).-
